2025 Conference: How to Complete Marital and Non-Marital Tracings and How to Equalize Multiple Retirement Accounts

When separate property is commingled with marital property, a tracing may be needed to track the components of each portion to carve out the marital and non-marital portions. This session will explore Case Studies on what is required to compile the data and how to put together a report showing the methodology. We will work through step by step instructions on how to input the needed data and how to run the calculations using Excel (complete with cell formulas) and discuss various scenarios that you will encounter so you are prepared to assist your divorcing clients in getting a fair distribution of their marital assets.
We will also review Case Study's to discuss the why, when and how of equalization and offset when divorcing couples have various accounts and want to offset and award from only one of the accounts.
